1. Scope and definitions
These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop under the brand "ColorWay" between:

(hereinafter "Seller")

and the customer.

A customer is any consumer within the meaning of Section 13 of the German Civil Code (BGB) as well as an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB).

2. Contracting parties, language and conclusion of contract

(1) The purchase contract is concluded with Digitale Schnecken International UG (limited liability), HRB 27370, represented by Oleg RYZHYKH.
(2) The contract language is German.
(3) The contract text is not stored permanently. Customers will receive an order confirmation via email after placing their order.

3. Technical steps for concluding the contract

The customer can select products without obligation and collect them by clicking the "Add to Cart" button. The order process is initiated by clicking the "Checkout" button. Input errors can be corrected before submitting the order. By clicking the "Order with payment" button, the customer submits a binding offer.

4. Prices and shipping costs

(1) All prices are quoted in euros.

• For consumers: including statutory VAT.

• For businesses: plus statutory VAT, unless otherwise stated.

(2) Shipping costs are shown separately during the ordering process.

5. Delivery and delivery times

(1) Delivery takes place within Germany and to selected EU countries.
(2) The delivery time is 1-3 working days, unless otherwise stated.

6. Terms of payment

The following payment methods are available:

• Prepayment / Bank transfer

• PayPal, credit card, Shopify Payments (if enabled)

• Purchase on account for registered B2B customers by arrangement

7. Retention of title

The goods remain the property of the seller until full payment has been made.
With regard to entrepreneurs, the retention of title applies until all claims arising from the current business relationship have been settled in full.

8. Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. Further information can be found in our cancellation policy.
There is no right of withdrawal for entrepreneurs.

9. Warranty and liability for defects

(1) The statutory liability for defects applies.
(2) For businesses, the warranty period is 12 months. Defects must be reported in writing immediately, and no later than within 7 days.

10. Liability

(1) The seller shall be liable without limitation in the event of intent and gross negligence.
(2) In the case of slight negligence, the Seller shall only be liable for breaches of essential contractual obligations (cardinal obligations), limited to foreseeable damage.

11. Special features for entrepreneurs (B2B)

(1) Entrepreneurs are obliged to provide a VAT ID.
(2) Minimum order quantities, tiered prices or individual conditions can be agreed within the framework of a merchant account.
(3) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12. Online dispute resolution and consumer arbitration

The EU Commission provides a platform for online dispute resolution:

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions

(1) Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected.
(2) For contracts with entrepreneurs, the exclusive place of jurisdiction is Aachen.
(3) The law of the Federal Republic of Germany shall apply.
